Md. Orders Linkwood Chicken Rendering Plant Shut Down for Corrective Actions

Maryland regulators have ordered a shutdown of a problem-plagued Eastern Shore chicken rendering plant after a tip from an environmental group led them to discover a batch of new pollution violations there.

The Maryland Department of the Environment on Dec. 21 directed Valley Proteins Inc. to cease operations at its facility in Linkwood in Dorchester County until it can meet its wastewater discharge permit limits and reduce the risk of overflows from its storage lagoons. The MDE threatened to fine or suspend the plant’s permit altogether if it failed to comply with prescribed corrective actions.

Michael A. Smith, vice chairman of the Winchester, VA, based company, said it had agreed to a temporary shutdown until it can lower the levels of its storage lagoons and meet permit requirements.

“We are working cooperatively with MDE to resolve the issue as quickly as possible,” Smith said.

The shutdown order comes after a series of MDE inspections this month found multiple problems at the facility. According to MDE inspection reports, those included an illegal discharge into a holding pond, discharges of sludge and inadequately treated wastewater into a stream leading to the Transquaking River, and leaks and overflows from treatment tanks.

The inspections were triggered by drone images provided by ShoreRivers, a coalition of Eastern Shore riverkeeper organizations, showing a grayish discharge from the rendering plant’s wastewater outfall, according to a letter MDE Secretary Ben Grumbles wrote to a Valley Proteins executive.

Choptank Riverkeeper Matt Pluta, a member of ShoreRivers staff, said that while doing aerial surveillance on Dec. 10, he saw “a large, discolored discharge” coming from the Linkwood facility and flowing downstream toward the Transquaking.

The MDE inspected the plant later the same day and reported it found acidic, inadequately treated wastewater being released into a stream, chlorine-treated wastewater leaking onto the ground, and foam and wastewater overflowing from another treatment tank.

The following week, more MDE inspections found waste sludge in a stream outfall leading to the Transquaking, continuing improper discharges both to the stream and onto the ground and inadequate cleanup of earlier detected leaks, spills and overflows. The MDE also found raw chicken waste on the ground. Regulators ordered the plant to cease discharges until the wastewater could be treated sufficiently to meet its permit limits.

“Chemical spills, tanks are overflowing, illegal discharges coming from all over the treatment process. It’s an absolute mess,” Pluta said of the conditions described in the inspection reports.

Neighbors and environmental groups have complained for years about the Valley Proteins plant, which takes up to 4 million pounds of chicken entrails and feathers daily from poultry processing plants and renders them into pet food.

The Transquaking, which flows into Fishing Bay, a Chesapeake Bay tributary, has been classified for more than two decades as impaired by nutrient pollution. The rendering plant is the river’s largest single source of such pollution, which fuels algae blooms and reduces oxygen levels in the water below what’s healthy for fish and other aquatic animals.

In his Dec. 16 letter to the company, the MDE’s Grumbles called the Linkwood plant’s operations “unacceptable.” He said the company’s recent compliance record “indicates a pattern of improper operations and poor decision-making regarding water pollution and air emissions issues.”

Another follow-up inspection on Dec. 20 found evidence of more sludge having been discharged in recent days, despite cleanups of earlier releases and leaks. The inspector also found that the plant had stopped discharging and its wastewater lagoons were filling up, despite some of the wastewater being trucked away. That prompted the shutdown order.

Valley Proteins’ Smith said the company is complying.

“We have a plan in place to move as much of our incoming supply to other [renderers] and or landfills in the short term,” he said by email. The company also has arranged, he said, to lower the levels in its storage lagoons by trucking “treated clarified water” from them to an unnamed local wastewater plant.

“We have seen our system improve over the last few days and anticipate being able to operate shortly,” he concluded.

MDE spokesman Jay Apperson said Valley Proteins is putting together a plan for returning to operation, but he said the company’s plan would have to persuade the MDE that it will comply with its discharge limits and other permit requirements.

In April, Pluta’s ShoreRivers group joined with the Chesapeake Bay Foundation and Dorchester Citizens for Planned Growth to threaten a lawsuit against the company, accusing it of repeatedly exceeding discharge limits on pollutants such as fecal coliform bacteria, nitrogen, phosphorus and ammonia.

The plant has been operating on an outdated discharge permit since 2006, and neighbors and environmental groups have been calling on the MDE to impose tighter requirements. Meanwhile, in 2014, the company applied for state approval to nearly quadruple its wastewater output, from 150,000 gallons to 575,000 gallons daily.

In September, the MDE released a new draft permit that would tighten limits on what the company could discharge. State regulators set caps on discharges of nitrogen and phosphorus that would require the company to upgrade its wastewater treatment facility, even if it did not expand operations.

State regulators also vowed to seek “a significant financial penalty” as well as corrective actions for a series of water and air pollution violations it had documented at the Shore facility.

That represented a shift in the MDE’s approach to the rendering plant. Earlier this year, the department had planned to provide Valley Proteins nearly $13 million to upgrade the wastewater treatment system at its Linkwood facility. Some lawmakers objected to giving public funds to a private company with a history of discharge violations, and the legislature limited such grants to half of any projected cost. After finding more violations at the plant, the MDE subsequently withdrew the grant offer.

Critics of the plant welcomed the MDE’s pledge to take enforcement action. But at hearings in October and November, they demanded that the state put more teeth in the plant’s discharge permit. They called for independent monitoring of its discharges, curbs on any planned increase in the rendering plant’s operations until it corrects all deficiencies and the MDE pledges to fine and take enforcement action for any future violations.

Pluta said the latest developments add to his concerns about the rendering facility and about the state’s ability to oversee it.

“We recognize that there’s a need for this type of operation,” he said, “but if you can’t operate within the guidelines of the law, of your permit, then you shouldn’t be able to operate at all.”

Pluta also questioned whether the MDE has enough staff and resources to ensure compliance, noting that the MDE only discovered problems there after he reported seeing a suspicious discharge.

“They’ve been inspecting monthly and didn’t come up with all this stuff,” he said.

The public comment period on Valley Proteins’ draft permit, which was extended for 60 days, remains open until Jan. 14, 2022.

MDE spokesman Jay Apperson said department officials will consider all comments received in making a final decision on the company’s permit application.

But Apperson also released a statement from the MDE secretary, saying, “We are much more focused on enforcement and correcting any ongoing violations before taking any actions on a draft permit.”

Md. Moves to Curb Water Pollution from Linkwood Chicken Rendering Plant

After years of complaints from its neighbors, state regulators have ordered a poultry rendering plant on Maryland’s Eastern Shore to curtail its pollution of a Chesapeake Bay tributary and say they will crack down on environmental violations there.

The Maryland Department of the Environment last week released a new draft wastewater permit for the Valley Proteins Inc. facility in Linkwood that would tighten limits on what it now releases after treatment into the Transquaking River.

“Our proposed actions mean cleaner water and a healthier watershed, with greater accountability for environmental violations,” MDE Secretary Ben Grumbles said in a Sept. 15 press release. The release said the agency would seek a “significant financial penalty” as well as corrective actions for a series of alleged water and air pollution violations at the plant.

Environmental activists welcomed the MDE’s announcement, but said it was long overdue.

“It’s good to see some movement to protect water quality,” said Matt Pluta, head of Riverkeeper programs for the nonprofit group ShoreRivers. “This is what we expected from them all along.”

Local residents and environmental activists have complained for years that the state hasn’t taken steps needed to improve water quality in the Transquaking, which flows through Blackwater National Wildlife Refuge before emptying into Fishing Bay and then the Chesapeake Bay just above Tangier Sound.

The river has been classified for more than 20 years as impaired by nutrient pollution. The rendering plant is the river’s largest single source of such pollution, which fuels algae blooms and reduces oxygen levels in the water below what’s healthy for fish and other aquatic animals.

The state has allowed the facility to operate under a discharge permit that expired in 2006, despite a federal law requiring such permits be renewed every five years. Pluta called it the oldest “zombie,” or expired, permit in Maryland. “MDE has let it continue operating without updated [pollution] controls for 15 years,” he said.

In April, the Chesapeake Bay Foundation, ShoreRivers and Dorchester Citizens for Planned Growth jointly notified Valley Proteins that they intended to sue it for violating the federal Clean Water Act by repeatedly exceeding permit limits on its discharge of pollutants such as fecal coliform, nitrogen, phosphorus and ammonia.

The plant takes up to 4 million pounds of chicken entrails and feathers daily from poultry processing plants, according to MDE documents, and renders them into pet food. It’s currently permitted to discharge up to 150,000 gallons of treated wastewater daily, and it uses an air scrubber to control odors.

In the draft permit, the MDE has set caps on how much nitrogen and phosphorus the plant can discharge, regardless of volume. Those caps represent a 43% and 79% reduction from what is permitted now. To stay within those limits, the plant will have to upgrade its treatment, even at the current maximum discharge volume of 150,000 gallons per day.

But in 2014, the company sought state approval to increase its maximum allowable discharge to 575,000 gallons daily in order to expand production. Local residents and environmental groups objected, arguing that the facility already was polluting the water, and the issue has been unresolved until now.

Earlier this year, the MDE disclosed in budget documents that it intended to give Valley Proteins a $13 million state grant to help upgrade its treatment facility so it could reduce its nutrient discharge while expanding operations. The grant would have covered more than 80% of the estimated cost of the overhaul. It would have been the first such grant to a private company from the state’s Bay Restoration Fund, which has been used primarily to upgrade municipal sewage systems.

MDE officials contended that the grant was warranted because it would help the plant achieve enhanced nutrient removal in its wastewater treatment operation, the same standard applied to large municipal sewage plants. But the General Assembly cut the allowable grant amount to $7.6 million after critics contended that the private company based in Winchester, Va., could afford to pick up a larger share of the tab.

Now, though, amid allegations of pollution violations at the plant, the MDE has decided not to provide the grant to Valley Proteins.

“The company has a lot of explaining to do, and the competition for [Bay Restoration Fund] dollars among other applicants is continuing to grow,” Grumbles said in a statement emailed in response to queries.

The draft permit would give the company the option in the next few years to boost its wastewater output to accommodate increased production. But it would still have to adhere to the annual caps set on the amounts of nitrogen and phosphorus it can discharge. That would necessitate upgrades completely at the company’s own expense.

With the state grant off the table, Michael A. Smith, Valley Proteins vice chairman, indicated that the company would forego the overhaul the MDE says it would need to expand operations.

Instead, Smith said, the company plans to make less costly upgrades, which should be enough to meet the new nutrient limits with its current volume discharge.

“So there will be capital improvements but not to the magnitude it could have been had the funding come through,” Smith said.

Activists said they are guardedly optimistic but intend to keep pressing the MDE on tightening the permit.

“With an upgraded plant, we can expect lower levels of nutrients and [other] pollution,” ShoreRivers’ Pluta said. “We can only hope,” he added, that the plant does what’s needed to achieve enhanced nutrient removal.

Fred Pomeroy, president of Dorchester Citizens for Planned Growth, said he was pleased after years of advocacy to “finally get affirmation from MDE that the longstanding pollution issues will be addressed in the Transquaking River.”

And Alan Girard, Eastern Shore director for the Chesapeake Bay Foundation, said activists were encouraged by the MDE’s announcement “after more than a decade of inaction. However, appropriate actions must be taken in response to the company’s repeated violations of the current permit and to ensure there is a commitment from Valley Proteins to comply with new pollution limits.”

The company has been fined a total of $5,000 over the last five years, according to a U.S. Environmental Protection Agency database. In the April notice of their intent to sue, the environmental groups said that public reports the company submits to state and federal regulators show the plant has repeatedly exceeded its discharge limits in recent years.

The groups also suggested that high nitrate levels found in monitoring wells may be from water leaking into groundwater from two wastewater storage lagoons on the property. They further alleged that the company hasn’t properly documented the tons of poultry waste sludge that is hauled away from the plant.

In its press release, the MDE said its investigators have found multiple infractions from July 2018 to the present. MDE spokesman Jay Apperson said those include exceeding currently permitted limits on several pollutants, plus an unauthorized discharge of only partially treated waste.

Also, in response to odor complaints, an MDE inspector visited the plant in August and cited it for an air pollution violation after finding fault with the operations and monitoring of its emission scrubber.

The draft permit includes updated groundwater monitoring requirements that the MDE said could provide more information about potential sources of pollution. It also contains more requirements for proper sludge management and reporting on its disposal.

“We are working with the facility, citizens and advocacy groups to ensure environmental progress using our regulatory enforcement tools,” the MDE’s Grumbles said.

Major Pollution Violations Found at Maryland’s Two Largest Sewage Treatment Plants

Baltimore has long been plagued by sewage leaks and overflows fouling its waters. Now, the city has a new pollution woe: poorly maintained municipal sewage treatment plants that for more than a year have been daily dumping millions of gallons of bacteria– and nutrient-laden wastewater into rivers that flow into the Chesapeake Bay.

Following a watchdog group’s discovery of high bacteria levels in wastewater coming from one of the city’s two sewage treatment plants, an inspector for the Maryland Department of the Environment has found “numerous deficiencies and violations” at both facilities.

In visits to the city’s Patapsco Wastewater Treatment Plant in May and to the Back River plant in June, the MDE inspector found operational and maintenance problems, with key treatment equipment malfunctioning or out of order, staffing shortages and botched sampling for toxic contaminants in the wastewater.

The laundry list of problems uncovered at Maryland’s two largest wastewater plants threatens Bay restoration efforts, environmentalists warn. It also raises questions, they say, about the diligence of state regulators in ensuring compliance with pollution limits.

City public works officials are scheduled to meet Friday with state regulators following an Aug. 23 letter from the MDE demanding immediate corrective actions and warning the city that it faces fines of up to $10,000 per day and possible legal action by the state attorney general.

“We’re going to hold [the Department of Public Works] accountable,” MDE Secretary Ben Grumbles said in an interview. “They have a lot of explaining to do.”

In response to press queries, a spokesman released a short statement from Public Works Director Jason Mitchell. He said that his staff “has developed a strategy to get back into compliance and will be providing a timeline for compliance to MDE.”

Alice Volpitta, the Harbor Waterkeeper, said she and her colleagues at the nonprofit watershed group Blue Water Baltimore were “pretty shocked” by the scope and severity of problems uncovered at the city’s wastewater plants after the group reported detecting high fecal bacteria levels in the Patapsco plant’s discharge in April and early May.

In prior years, Volpitta said, Blue Water Baltimore’s monitoring program had picked up occasional bacteria spikes at the Patapsco plant, usually when it was overwhelmed by inflows from heavy rains. But this past spring, she and her team detected “consistent ongoing high bacteria readings” unrelated to rainfall at the plant’s outfall just upriver of the Key Bridge.

The city has spent $1.6 billion since 2002 to comply with a state-federal consent decree requiring an overhaul of its sewer network to halt frequent overflows and leaks of untreated sewage. At the end of 2020, city officials announced the near completion of a $430 million “headworks” project at the Back River plant, which officials predict will eliminate 83% of the overflows. The city is also spending millions annually to curb polluted stormwater runoff from streets, parking lots and buildings.

But because those two plants treat a high volume of wastewater, their discharges of inadequately treated sewage threaten to offset those efforts, environmentalists contend. Back River discharges about 72 million gallons of wastewater daily, while Patapsco releases about 55 million gallons.

According to Blue Water Baltimore, the combined daily discharge of the two plants would fill a 2.5-foot deep wading pool the size of the city’s 155-acre Patterson Park. By sheer volume alone, not the amounts of pollutants, the plants’ daily combined discharge is on par with the cumulative amount of rain-diluted sewage that overflows each year across the city.

“If we can’t trust our wastewater treatment plants to actually treat the sewage,” Volpitta said, “it doesn’t really matter much what other … best practices we’re putting on land.”

Documented violations

The MDE inspection reports detail numerous violations at each plant, many of them similar.

At the Patapsco plant, the MDE inspector found it had repeatedly violated limits since July 2020 on levels of harmful bacteria, phosphorus, nitrogen and total suspended solids. Overall, the plant exceeded its total authorized nitrogen discharge for 2020 by nearly 140,000 pounds and surpassed its total phosphorus load by 47,800 pounds. Fewer than half the units used to screen incoming sewage were operational, and those were so clogged with trash and debris they couldn’t work properly, the inspector found.

Plant managers blamed the exceedances on equipment failures and on a worker shortage because of the coronavirus pandemic, the MDE report said.

But the MDE inspection found that the Patapsco plant also has failed to comply with a 2016 consent order requiring it to reduce discharges of fats, oils and grease into the river. The city had yet to upgrade or replace equipment needed to remove the pollutants, despite a 2018 deadline, and only 5 of 18 settling tanks to be used for the removal were working at the time of the visit. Some were so full of scum the inspector warned they would also fail soon without prompt maintenance.

At the Back River plant, the MDE inspector said the discharge exceeded permit limits on pollution every month but one from August 2020 through May 2021, with excessive levels of nitrogen, phosphorus, total suspended solids and ammonia, and a couple of instances of elevated bacteria. Plant managers said there had been a malfunction of a key piece of equipment, a centrifuge used to separate solids from liquids. But the inspector noted that the exceedances began months before that breakdown and that managers had failed to report excessive discharges promptly to the MDE, as required.

During his June walk-through, the MDE inspector also found “malfunctioning equipment because of maintenance problems” and that only two of 76 plant operators had permanent licenses, an indication of their level of training and expertise to run and maintain the facility properly. Plant managers told the inspector that some staff had failed to pass the licensing test and others had declined to take it because there was no incentive to do so.

The inspection further found defective sampling at Back River for toxic contaminants, particularly for polychlorinated biphenyls or PCBs, which rendered the results useless in gauging how much is being removed or discharged into the river. Fish consumption advisories throughout the Baltimore area advise recreational anglers to limit their meals of locally caught fish because of the buildup of PCBs in them.

Oversight questioned

MDE Secretary Grumbles said it is a “high priority” for state regulators to quickly rectify the situation.

“We know how important of a partner the city is in reducing pollution and helping the state meet its [Baywide nutrient reduction] requirements,” Grumbles said. “When there are problems at a treatment plant [involving] operation and management of the facility, that’s a heightened concern for us.”

Volpitta praised the MDE for taking action but said she was perturbed that the agency didn’t catch the problems sooner. She noted that in the year before Blue Water Baltimore’s sampling, the city had been filing required monthly discharge monitoring reports with the MDE and EPA, which made it clear that some pollutants were exceeding permitted levels.

“That’s the big question,” she said. “Why did it take so long for anything to come of that self-reporting?”

Grumbles said that MDE staff started looking at the plants’ monthly reports and getting information from the city in March. At that time, he said, they saw a “trend that was totally unacceptable” and began preparing for inspections.

The first inspection took place the day after Blue Water Baltimore gave the MDE its water quality findings. At the time, Volpitta said, MDE officials didn’t give any indication they were already aware of problems at the Patapsco plant.

“I think there’s a lot of questions to be answered here,” she said. “We’re very concerned about the lack of oversight that appears to have occurred.”

For the safety of its staff during the coronavirus pandemic in early 2020, the MDE cut back on physical inspections of facilities discharging into state waters. But even before that, it had begun conducting a growing number of compliance checkups without leaving the office, by reviewing plants’ self-reported data.

Before this year, the MDE had physically inspected the Patapsco plant twice in 2016 and once each in 2017, 2018 and in June 2020, according to a spokeswoman. The Back River plant was inspected once in 2016, five times in 2017, twice in 2018 and once in 2019, she said. Three of the 2017 inspections were in response to complaints, the spokeswoman noted, without providing additional information.

Mitchell, the city’s public works director, said in his statement without elaborating that “the root causes for the violations have been identified by DPW and will be addressed systematically to ensure we achieve 100% compliance.”

Grumbles said, “it’s a priority for us to get this resolved as quickly as possible.”

But Volpitta said that, given the findings of the MDE inspections, she doubts there’s a quick fix to all the problems.

Josh Kurtz, Maryland director of the Chesapeake Bay Foundation, called for swift enforcement action against the city, but also questioned the state’s oversight of such facilities.

“Marylanders depend on government agencies to be transparent and accountable when problems arise,” Kurtz said in a statement Tuesday. “In this case, it appears Baltimore’s Department of Public Works failed for years to address known problems at the city’s two wastewater plants, which led to months of partially treated wastewater flowing into the Baltimore Harbor and Chesapeake Bay during the previous year.”

And even if the MDE was investigating the plants before Blue Water Baltimore reported its findings, Kurtz found fault with the low-key way it was handled until this week.

“Neither DPW nor Maryland Department of the Environment, the agency tasked with enforcing state pollution regulations, publicly addressed these ongoing issues at the plants until the nonprofit Blue Water Baltimore issued their findings in a news release [on Monday],” he said.

The MDE has relied heavily on upgrading wastewater treatment plants to meet its nutrient reduction obligations under the Bay’s “pollution diet,” formally known as the total maximum daily load, which the EPA imposed in 2010.

“With such a heavy reliance on these upgrades,” Kurtz said, “the state must prioritize oversight of these facilities to ensure proper operation and impose penalties for violations.” Failures at large plants like Patapsco and Back River can undermine the overall Bay restoration effort, he added.

Kurtz also said the city and state owe more diligence to the health of Baltimore area residents. “Both plants serve and discharge into rivers and streams where underserved and frontline community members live,” he said. “These communities have suffered from a legacy of disproportionate impacts of dangerously high levels of pollution, especially harmful bacteria.”

Maryland is on track toward reaching its Chesapeake Bay pollution reduction goals by 2025, but advocates say the state needs to plant more trees to address stormwater runoff from farms and land development. 

The majority of the state’s pollution reduction has come from modifying wastewater treatment plants, while pollution from agriculture and urban and suburban storm water runoff remain relatively high, Alison Prost, vice president of environmental protection & restoration for the Chesapeake Bay Foundation, told members of the House of Delegates Environment & Transportation Committee Thursday. Sixty-four of 67 wastewater treatment plants in Maryland have been upgraded already, she said.

“In the future, we really don’t have a lot more to gain from wastewater treatment. Where the lion share of the opportunity is in agriculture,” Ann Pesiri Swanson, executive director of Chesapeake Bay Commission, told state lawmakers. “Agriculture is very, very challenging, requires a lot of technical assistance and a lot of cost-share as well.”

Agriculture cost-share programs provide federal and state funding to help pay farmers’ costs for installing conservation practices, such as planting forested buffers or fencing livestock out of streams.

In 2010, the U.S. Environmental Protection Agency set the Chesapeake Bay Total Maximum Daily Load (TMDL) pollutant reduction target, which requires six Bay states and the District of Columbia to implement plans that would reduce nitrogen, phosphorus and sediment pollution into the Bay by 2025. The goal is not to have clean water by 2025, but to have all the proper practices that will deliver clean water by 2025.

Between 1985 and 2018, total nutrient pollution in the Bay declined by 83 million pounds. But to reach pollutant reduction goals by 2025, an additional 52 million pounds of pollution must be eliminated, according to Swanson.

Although the Conowingo Dam, a 90-year old hydroelectric dam in the lower Susquehanna River in Maryland, was expected to continue trapping nutrients and sediment behind the dam until 2025, water has been running over the dam and into the Chesapeake Bay, even in low-flow storms, Swanson explained.

That adds 6 million pounds of pollutants. And climate change has added another 5 million pounds.

“This is like new calories coming into the body and you’ve got to incorporate them into your diet,” Swanson said, causing Maryland’s share to reach the 2025 pollutant reduction goal to rise from 6.2 million pounds to 7.5 million pounds.

“The place you’re going to find those additional pounds remain [in] agriculture, storm water, [and] septic because for the most part, we’ve addressed wastewater,” Swanson said.

Sixty percent of future nitrogen reductions planned will come from best management practices, tools that farmers use to reduce soil and fertilizer runoff, such as animal waste management systems and planting more trees as buffers, Swanson said.

Since the Bay states began working toward their own pollution reduction goals, Pennsylvania — home to most of the Susquehanna, which empties into the the Chesapeake at the top of the Bay — has consistently lagged in meeting its goals. That led the Chesapeake Bay Foundation and other organizations to file a complaint in September against the EPA for failing to require Pennsylvania, as well as New York, to develop plans that sufficiently reduce pollution as required by the Chesapeake Clean Water Blueprint.

“Unless Pennsylvania gets on track, we’re going to have a tough time meeting 2025,” Prost said.

Only 30% of Pennsylvania’s state legislators represent jurisdictions in the Bay watershed, and Pennsylvania’s political and philanthropic “power centers” are outside the Bay watershed, Marel King, Pennsylvania director of the Chesapeake Bay Commission, told state lawmakers. The lack of support in Pennsylvania’s legislature explains the consistent lack of funding from that state to restore the Bay’s health.

Advocates also talked about the realities of climate change and impacts it will have on Maryland’s 2025 pollution reduction goals. Warmer water temperatures cause oxygen levels to decrease, which could expand the Bay’s dead zone areas, Prost said.

To start addressing that impact, Maryland’s legislature could push the Maryland Department of the Environment to update its permits to account for climate change. Currently, MDE’s calculations for storm water runoff are based on numbers from 15 years ago, Prost said. As storms are expected to get stronger and cause more flash flooding in the near future, there need to be stronger controls to prevent runoff from construction sites, Prost said.

It is important that the state have a multi-pronged approach and invest in strategies that address climate change, flooding and water quality together, rather than focus on water quality alone, advocates said.

The state should focus on planting trees as part of the climate solutions bill, Prost said. Not only can trees slow and strain storm water runoff into the Chesapeake Bay, but they can also capture and store carbon dioxide, reducing it in the air.

“The reality is for water quality, for climate, for community resilience, trees is where the investment needs to go,” Prost said. “It’ll help us meet our watershed improvement plan goals, and if we invest more in trees it’s going to help us with those additional pounds that Maryland now needs to find related to climate change.”

EPA hit with lawsuits over Chesapeake Bay cleanup

Making good on threats issued months ago, three Chesapeake Bay watershed states, the District of Columbia and the Chesapeake Bay Foundation took the U.S. Environmental Protection Agency to court Thursday for its failure to push Pennsylvania and New York to do more to help clean up the Bay.

In their lawsuit, the attorneys general of Maryland, Virginia, Delaware and the District of Columbia accused the EPA of shirking its responsibility under the Clean Water Act by letting Pennsylvania and New York fall short in reducing their nutrient and sediment pollution fouling the Bay.

“This has to be a collective effort,” said Maryland Attorney General Brian Frosh. “Every state in the Chesapeake Bay watershed has to play a part, and EPA under the law has to ensure that happens.”

The Chesapeake Bay Foundation, joined by the Maryland Watermen’s Association, a pair of Virginia farmers and Anne Arundel County, Md., made similar complaints in a separate federal lawsuit. Both were filed in U.S. District Court for the District of Columbia, where they’re likely to be consolidated into a single case.

“The courts must ensure that EPA does its job,’’ Will Baker, the Bay Foundation president, said in an online press conference held with attorneys general from Maryland, Virginia and the District.

At issue is the EPA’s duty to enforce a decade-old plan the agency drew up for restoring the Chesapeake to ecological health. The plan, known as a total maximum daily load, requires each of the Bay watershed states and the District to do what’s needed by 2025 to reduce their share of the nutrient and sediment pollution harming the Bay.

Progress has been made toward restoring the Bay’s water quality, though much more remains to be done. In particular, Pennsylvania and New York have fallen far behind in meeting their pollution-reduction targets, especially in curbing nutrient runoff from farmland.

All six Bay watershed states and the District were required to submit plans last year spelling out the measures each would take by 2025 to make the needed pollution reductions.

Most of the plans indicate that states will have to increase pollution-reduction efforts to unprecedented levels to reach their cleanup goals. But Pennsylvania’s and New York’s plans don’t even achieve their goals on paper. Pennsylvania’s falls short on curbing nitrogen, the most problematic nutrient, by about 25%, while New York’s was around 33% short. Pennsylvania’s plan also identifies an annual funding gap for cleanup activities of approximately $250 million a year through 2025.

The EPA cited those shortcomings for both states but hasn’t taken any action against them. The lawsuits contend that the federal government is abdicating its legal responsibility by accepting clearly inadequate cleanup plans with no reasonable assurance the two states can achieve their assigned pollution reductions.

Without responding directly to the lawsuits’ core complaint, an EPA spokesman issued a statement defending the agency’s role in the Bay cleanup.

“EPA is fully committed to working with our Bay Program partners to meet the 2025 goals,” the statement said. “We have taken and will continue to take appropriate actions under our Clean Water Act authorities to improve Chesapeake Bay water quality.”

The spokesman noted that in just the past year, the EPA and other federal agencies have supplied “nearly a half billion dollars” to support Bay watershed restoration efforts. The agency also has provided “thousands of hours” of technical assistance to the states, it said.

Those filing the lawsuits say that’s not enough. Unless the federal government holds the states accountable for doing their part to reduce nutrient and sediment pollution, the 37-year effort to restore the Bay’s water quality is likely to fail, they warn.

“When EPA uses its bully pulpit to tell a state that they’re failing to meet their obligations, action follows,” said the foundation’s Baker. “We’ve seen that with Pennsylvania in the past.”

The agency briefly withheld about $3 million in federal funds from Pennsylvania five years ago to prod it to come up with a plan for getting its cleanup back on track. Critics suggest the EPA also could leverage state compliance by threatening to block permits that are needed to build or expand businesses.

Environmentalists and Maryland officials have been complaining for some time that the EPA is not doing more to press Pennsylvania over its lagging cleanup pace. But discontent ramped up in January when Dana Aunkst, director of the EPA’s Chesapeake Bay Program office, described the 2025 cleanup deadline as “aspirational” and said the Bay TMDL was “not an enforceable document.”

The litigants said they didn’t relish taking the EPA to court but felt they had no choice. They faulted the Trump administration, contending it had not only abandoned the federal government’s role as enforcer of the Bay TMDL, but had threatened the cleanup further by rolling back or weakening federal environmental regulations.

The Annapolis-based environmental group and the attorneys general had served the EPA formal notice in May of their intent to sue and followed up later with a letter offering to meet and discuss their concerns. The EPA did not respond, they said.

“We’re here to enforce the agreements,” said Karl Racine, the District’s attorney general. “It’s not unusual at all that when parties don’t do what they’re supposed to do by law, we go to court to have it enforce the remedy.”

Neither Pennsylvania nor New York are defendants in the lawsuits, though their alleged shortcomings are key issues. Deborah Klenotic, spokeswoman for the Pennsylvania Department of Environmental Protection, declined to comment on the litigation, saying, “We remain focused on our work to improve water quality here in Pennsylvania and in the Chesapeake Bay.”

But Maureen Wren, a spokeswoman for the New York Department of Environmental Conservation, disputed assertions the state isn’t doing its part to help clean up the Bay.

“New York is fulfilling its clean water responsibilities under the Chesapeake Bay TMDL and is a committed partner” in the federal-state Chesapeake Bay Program, she said.

State officials now expect to meet New York’s nitrogen reduction targets based on new information about Susquehanna flows and a change in the Bay Program’s computer model.

Maryland’s Anne Arundel County, which has more than 500 miles of shoreline on the Bay and its tributaries, joined the foundation in its lawsuit.

“Anne Arundel County residents have invested far too much in the Chesapeake Bay restoration effort to watch from the sidelines as upstream states and the EPA abandon their obligations,” said Anne Arundel County Executive Steuart Pittman. The county has spent more than $500 million in the last decade on Bay protection and restoration, officials estimate.

The Maryland Watermen’s Association, which has been at odds with the Bay Foundation over the state’s management of oysters, also joined in the group’s lawsuit. Observing that “water runs downhill,” Robert T. Brown, Sr., the group’s president, said the nutrients, sediment and debris coming down the Susquehanna River from Pennsylvania and New York are having a devastating effect on watermen.

“So goes the health of the Bay, so goes [our] industry and seafood,” he said. “…We need to have the EPA do its job.”

Also suing are Robert Whitescarver and Jeanne Hoffman, who raise livestock on a farm in Virginia’s Shenandoah Valley. Whitescarver, a former Natural Resources Conservation Service representative, has long advocated for farm conservation practices. He said farmers have a stake in this issue.

“All jurisdictions need to do their fair share,” he said. “The efforts that Virginia and Maryland farmers have put into sustainable farming are harmed by EPA’s failure to require all jurisdictions to meet the commitments they agreed to.”

At least a couple of the states suing the EPA to put the heat on Pennsylvania and New York could find themselves on the receiving end of similar pressure if their lawsuit succeeds. Only the District of Columbia and West Virginia have met their 2025 goals ahead of schedule, according to recent data. None of the others are on track to reduce nitrogen by the needed amount.

“If any of the Bay states fall significantly short in implementation, CBF will call on EPA to take action,” Baker said.

Environmentalists Bash Leaders of Chesapeake Bay States for Backsliding

Leaders from six Chesapeake Bay watershed states, the District of Columbia, the Chesapeake Bay Commission and the U.S. Environmental Protection Agency have failed to address recent reports highlighting how some Bay states are not on track to meet their pollution reduction goals by 2025, environmental groups said Tuesday.

The Chesapeake Executive Council, which includes the leaders of Maryland, Virginia, Delaware, Pennsylvania, West Virginia, New York, D.C. and the EPA, met virtually Tuesday for its annual meeting. Gov. Lawrence J. Hogan Jr. (R) announced that the council had adopted a diversity statement, pledging to improve equity and a culture of inclusion throughout the states’ efforts to clean up the Bay.

“Just as natural ecosystems depend on biodiversity to thrive, the long-term success of the Chesapeake Bay restoration effort depends on the equitable, just and inclusive engagement of all communities living throughout the watershed,” the council’s statement said in part. “…For this effort to be successful it will require us to honor the culture, history and social concerns of local populations and communities.”

Hogan then turned the gavel over to Gov. Ralph S. Northam (D) of Virginia.

“Over my past three years as chair, we have worked together to implement real, bipartisan, common sense solutions to the challenges facing the Chesapeake Bay, and the results speak for themselves,” Hogan said. “Maryland remains fully committed to this historic partnership as we continue making strides to preserve this national treasure.”

However, the leaders did not address reports issued in the last few days by the Environmental Integrity Project and the Chesapeake Bay Foundation, both of which found that Maryland and Pennsylvania are regressing on their efforts to mitigate stormwater pollution runoff into the Bay. Both reports found that Pennsylvania in particular was far from meeting its pollution reduction goals by 2025.

“Once again this year, Bay restoration leaders ignored the elephant in the room. Pennsylvania’s plan to meet the goals that all agreed on is woefully inadequate and implementation is seriously off-track,” Chesapeake Bay Foundation President Will Baker said in a statement.

“Unless the Commonwealth finds a way to meet its commitments, the investments that the other Bay states are making will improve local water quality, but the Bay will not be restored,” he continued.

In 2010, the EPA established the Chesapeake Bay Total Maximum Daily Load (TMDL), which requires Bay states to implement plans that would reduce nitrogen, phosphorus and sediment pollution into the Bay by 2025. The federal agency is responsible for establishing accountability measures to ensure that each state meets its cleanup commitments.

A report released last week by the Chesapeake Bay Foundation found that although Maryland is on track to achieving its 2025 pollution reduction goals, it must focus more on reducing urban and suburban stormwater pollution runoff, as this will be Maryland’s second largest source of nitrogen pollution by 2025.

Although Pennsylvania has successfully reduced pollution from wastewater treatment plants, the report found that it needs to focus on reducing pollution from agriculture, which makes up 93% of the total remaining nitrogen reduction necessary to meet pollution reduction goals by 2025.

Another report by the Environmental Integrity Project released Monday found that Maryland’s 2019 Chesapeake Bay cleanup plan allows 1.5 million more pounds of nitrogen pollution from urban and suburban stormwater runoff into the Bay by 2025, or 20% more pollution, than its 2012 commitment.

Similarly, Pennsylvania’s Chesapeake Bay cleanup plan will allow 7 million more pounds of nitrogen pollution from stormwater runoff by 2025, a 87% increase from its 2012 plan.

“It was disappointing that today’s annual meeting of Chesapeake regional governors – only two of whom even bothered to show up – did not discuss the Bay’s serious pollution problems with any candor or depth, and did not even bring up the backsliding by Pennsylvania and Maryland on controlling urban and suburban stormwater pollution,” said Tom Pelton, spokesman for the Environmental Integrity Project.

“Governor Hogan praised the ‘incredible progress’ the states have made in cleaning up the Bay. But, in fact, the University of Maryland Center for Environmental Science’s most recent report card on the Bay showed that the estuary’s overall health rated a terrible 44 out of 100 in 2019, which was an even worse score than the 47 out of 100 score in 2010, when the current Bay cleanup efforts began,” Pelton continued.

The leaders from the Chesapeake watershed also did not mention Maryland, Virginia and the District of Columbia’s recent declaration that they intend to sue the EPA for its failure to enforce state pollution reduction plans, specifically Pennsylvania and New York.

“Once again, Pennsylvania’s progress has fallen short, and, once again, EPA has failed to hold them accountable. This should not be surprising, since this administration has spent the past three and a half years rolling back environmental regulations and enforcement mechanisms,” Kristen Reilly, director of Choose Clean Water Coalition, said in a statement.

“We would like to remind EPA that their role in this restoration effort is to hold the states to the commitments they have made to clean their local rivers, streams and ultimately the Chesapeake Bay.”
