Why not follow Justice Ginsburg’s own advice? In a similar case in an election year President Obama wanted to nominate Merrick Garland to fill Antonin Scalia’s just vacated seat. The Republican Senate blocked the nomination, arguing that it should await the election of a new president. Even though she was a sitting judge, Ginsburg felt so strongly about this that she publicly called on the Senate to go through with the nomination. “That’s their job,” she said in July, 2016. “There’s nothing in the Constitution that says the President stops being President in his last year.” She was right.

Ten months is quite a bit different than 6 weeks. The Senate set the rules last time. To do otherwise is to show just how corrupt they are. What RBG said was her dying wish was that the new president would decide who would fill her spot.

Mitch McConnell blocked a vote to approve Obama’s Supreme Court nominee, Merrick Garland, for more than seven months before the 2016 election, saying it was too close to the election, and that the next justice should be appointed by the incoming president. This was an abuse of his authority as Speaker of the Senate. But, now that he, himself, has set this precedent, he should abide by it. We need honorable leaders, not abusive hypocrites.
